川普希望宣佈進入國家緊急狀態後可以繞過國會正常撥款程序，動用國防部經費修建隔離牆。16個州因此共同狀告總統違憲。

美國加州等16州就特朗普宣布國家緊急狀態提起訴訟

美國16個州周一提起聯邦訴訟，挑戰總統特朗普通過宣布國家進入緊急狀態為美墨邊境牆提供資金的行動，與特朗普政府的這場對陣可能鬧上美國最高法院，而且可能會持續到2020年大選。

川普指出，他將用大約80億美元建造隔離牆。其中一部分是國會已經批准的，其餘部分來自他的行政命令，包括通過國家緊急狀態調用的資金。

川普認為，南方門戶洞開，美國遭到毒品、人口販子、及各類幫派及犯罪人士入侵，是真正危機，他自認宣布緊急狀態是好的事情。
